Sano Terms of Service

Welcome to Sano! These Terms of Service ("Terms") govern your access to and use of the website located at sano.fitness, our mobile applications, and our related services (collectively, the "Platform"). The Platform is operated by Launch Ops. Inc. DBA Sano ("Sano," "we," "us," or "our").
1. THE SANO PLATFORM (AGENCY DISCLOSURE)
Sano is a technology platform that facilitates bookings between consumers ("Members" or "you") and third-party fitness and wellness providers ("Partners").
Agency Status: Sano acts as a limited payment collection agent for our Partners. When you pay Sano, your obligation to pay the Partner is satisfied.
No Service Provider Status: Sano does not own, operate, or control the gyms, studios, or facilities. The Partner is solely responsible for providing the fitness or recovery services.
2. ELIGIBILITY & ACCOUNTS
Age: You must be at least 18 years old to create an account.
Accuracy: You agree to provide accurate, current, and complete information during the registration process.
Security: You are responsible for safeguarding your password and for all activities that occur under your account.
3. PAYMENTS, SUBSCRIPTIONS & REFUNDS
Pricing: Prices for memberships or class packs are set by Sano in coordination with our Partners. We reserve the right to change pricing at any time.
Billing: By providing a payment method, you authorize Sano to charge you for the selected services, including any applicable taxes.
Automatic Renewal. SANO SERVICES ARE PROVIDED ON A SUBSCRIPTION BASIS. BY SIGNING UP FOR A MEMBERSHIP, YOU AGREE THAT YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW EVERY FOUR (4) WEEKS / TWENTY EIGHT (28) CALENDAR DAYS, UNLESS AND UNTIL YOU CANCEL YOUR SUBSCRIPTION OR WE TERMINATE IT.
Recurring Charges. You authorize Sano to maintain your account information and charge the payment method on file the then-current subscription fee automatically on a recurring four (4) week / twenty eight (28) day basis on the anniversary of your signup date. If your payment method fails, we may suspend your access to the Platform until payment is received.
Cancellation Policy. You may cancel your subscription at any time. Cancellation is "Click-to-Cancel": you can terminate your subscription immediately through your App Settings.
If you cancel, you will continue to have access to the Services through the end of your current paid billing period.
There are no refunds for partial months or unused memberships.
No Refunds: All purchases are final and non-refundable unless otherwise required by law or specified in a Partner’s specific cancellation policy.
4. USER CONDUCT & PROHIBITED ACTIONS
You agree not to:
Use the Platform for any illegal purpose or in violation of local fitness facility rules.
Share your account or "transfer" classes to another individual without express permission.
Scrape, crawl, or use automated systems to extract data from sano.fitness.
Harass, threaten, or engage in discriminatory behavior toward Partner staff or other members.
5. HEALTH & SAFETY & PARTNER POLICIES
Assumption of Risk: You acknowledge that physical exercise involves inherent risks of injury or death. You voluntarily assume all risks associated with participating in any Partner Service.
Medical Clearance: You represent that you are in good physical condition and have no medical reason or impairment that would prevent you from safely using the Partner Services.
Partner Waivers: In addition to these Terms, you may be required to sign a specific liability waiver provided by the Partner gym before participating.
Partner Specific Policies: Each Partner Gym has its own rules regarding class cancellations, no-shows, and facility conduct ("Partner Policies"). By booking a class through Sano, you agree to abide by the specific Partner Policies displayed at the time of booking. Sano reserves the right to pass through any late-cancel or no-show fees charged by the Partner to your payment method on file.
6. INTELLECTUAL PROPERTY
All content on the Platform, including logos, text, software, and "the Sano look and feel," is the property of Sano or its licensors and is protected by copyright and trademark laws.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW (INCLUDING CALIFORNIA CONSUMER PROTECTION LAWS), SANO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. IN NO EVENT SHALL SANO’S AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO SANO IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
8. INDEMNIFICATION
You agree to indemnify and hold Sano harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your conduct at a Partner facility.
9. DISPUTE RESOLUTION (ARBITRATION & CLASS ACTION WAIVER)
Mandatory Arbitration: Any dispute arising out of these Terms shall be resolved via binding arbitration in San Francisco, California, administered by JAMS or AAA.
Class Action Waiver: YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION.
10. PRIVACY POLICY
Your use of the Platform is also governed by our Privacy Policy, which explains how we handle your Personal Information in compliance with the CCPA/CPRA. You can view it at sano.fitness/privacy.
11. GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
12. SMS COMMUNICATIONS
Sano SMS Verification Program
Sano sends SMS messages for account verification and login authentication purposes only. You will receive a one-time passcode (OTP) via SMS when you initiate a login or account recovery using your phone number.
You can cancel SMS verification at any time by replying STOP to any message. After texting STOP, you will receive a confirmation message and no further SMS messages will be sent. To re-enable SMS verification, simply initiate a new login with your phone number.
If you experience issues with SMS verification, reply HELP for assistance, or contact us directly at member@sano.fitness.
Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply. You will receive one SMS per login or account recovery request. Contact your wireless provider for questions about your text or data plan.

13. COMMUNICATIONS
By creating a Sano account, you agree that Sano may send you communications related to your account, your membership, and the Sano platform, including service updates, new gym and studio availability, and promotional offers. These communications may be sent via email or, if provided, SMS.
You may opt out of promotional communications at any time by clicking the unsubscribe link in any email or by contacting us at member@sano.fitness. Opting out of promotional communications will not affect delivery of transactional messages required to administer your account, such as booking confirmations and payment receipts.
